Filing Requirements

ALGERIA

• Filing Requirements:

The following documents and information are required for filing a trademark application in Algeria:

A power of attorney in French simply signed and sealed with the official stamp of the applicant company which should include the position and the name of signatory, company name and address, the date of the POA and the country or the place.  A separate power of attorney is required for each application and it is not acceptable to use one POA for two or three applications even if it is for the same applicant.

  1. The name and address of the applicant.

  2. The list of the goods/services to be covered by the application.

  3. An electronic representation of the mark. (Word marks are prepared locally).

  4. A certified copy of the priority document.

N.B:

  1. Document 1 should be submitted at the time of filing or at least a simple copy of the same by email provided that the original should be submitted at a later stage. Document 5 may be submitted within 3 months from filing date.

  2. Search results need about 6 to 8 weeks to be issued.

  3. Official trademark office search covers word marks and Logos  

• Time Frame:

Trademark applications undergo substantive examination in accordance with Article 7 of Ordinance No. 03-06 dated July 19, 2003. Trademark registration certificates are issued within approximately 15-18 months as from the application date.

• Validity:

A Trademark registration is valid for ten years from the date of filing the trademark application. 

• Notes:

  1. The above quotation includes all charges from the filing till the issuance of the Certificate of registration (in Normal cases).

  2. Services marks may be registered according to the 10Th Nice Classification.

  3. Once a trademark (word mark in English Language) is registered, its transliteration is automatically protected.

• Renewal Requirements:

  1. A power of attorney in French simply signed and sealed with the official stamp of the applicant company which should include the position and the name of signatory, company name and address, the date of the POA and the country or the place.  

  2. Decleration of use signed and sealed with the official stamp of the applicant company.

  3. Copy of the final registration certificate or last renewal certificate.

• Notes:

Kindly be advised that, the validity of the trademark registration in Algeria is ten years as from the filing date.  Thereafter, a trademark registration is renewable for further consecutive periods of ten years each. 

The renewal fees of a trademark registration can be paid during the last 12 months of the current protection period. There is a 6-months grace period within which a late renewal application can be filed, but such a late renewal application is subject to the payment of additional fees.

● Recordal of Change of name Requirement:

  1. A Power of Attorney simply signed and sealed with the official stamp of the applicant company.

  2. A certificate of change of name duly Notarized & Legalized up to the Algerian Consulate.  

  3. Number and date of the registered Trademark.

● Recordal of Change of address Requirement:

A Power of Attorney in the new address simply signed.

● Recordal of assignment Requirement:

  1. A Power of Attorney simply signed and sealed with the official stamp of the assignee company.

  2. Deed of assignment, notarized and legalized up to the Algerian consulate. with sworn French translation.

● Recordal of Merger Requirement:

  1. A Power of Attorney simply signed and sealed with the official stamp of the applicant company.

  2. Certificate of merger, notarized and legalized up to the Algerian consulate. with sworn French translation.

● Recordal of Licenses Requirement:

  1. Powers of attorney from proprietor and licensee simply signed and sealed with the official stamp of the applicant company.

  2. License agreement signed by the licensee and the licensor notarized and legalized up to the Algerian consulate. with sworn French translation.

• Notes:

The change of agent name and address is automatically recorded while providing a POA for the  service in question at no cost.

Applications and registrations may be assigned with or without the goodwill of the business concerned.
