OMAN
• Filing Requirements:
A power of attorney executed by the applicant, with an Apostille certification.
A certified copy of the certificate of incorporation of the applicant company, an extract of its entry in the commercial register or a good standing certificate including all relevant information.
Name, nationality, address, legal status, nature of business, etc. of the applicant company.
A list of the goods and services to be covered by the applications.
Prints of the trademark (15 each application).
A certified copy of the priority document must be submitted in case it is claimed.
N.B:
This is to inform you that with effect from January 30, 2012 the Power of Attorney is no more necessary to legalize at the Consulate of Oman, if the applicant’s country is a member of Hague Convention. The Apostille Power of Attorney is sufficient for filing with the Trademark Office.
Please be advised that it is permitted under the new practice of the Omani Trademark Registrar to file trademark applications and obtain filing number and date as well as the official filing certificate, renewal, recordal of change of name, address, assignment or license agreement without the complete required documents which should be submitted at a later stage after filing within sixty days from the filing date.
In the past and prior to these recent regulation it was permitted to file new trademark applications under the practice of the Omani Trademark Registrar to file trademark applications and obtain filing number and date as well as the official filing certificate without the complete required documents which can be submitted at any time and at no additional cost.
Search results need 4-5 working days to be issued.

• Time Frame:
The approximate time frame for completing the registration process of a trademark in Oman is from 12-16 months.
• Validity:
The duration of a trademark or service mark registration is for 10 years from the filing date.
• Notes:
Services marks may be registered according to the 10th edition of the Nice Classification.
A separate application is to be filed for each class of goods.
One set of document is sufficient for filing any number of applications for the same applicant.
If a trademark registered in English language in Oman, its transliteration is automatically protected.
• Renewal Requirements:
1- A power of attorney executed by the applicant, with an Apostille certification.
2- Copy of the final registration certificate or last renewal certificate.
• Notes:
The validity of the trademark registration in Oman is ten years as from the filing date. Thereafter, a trademark registration is renewable for further consecutive periods of ten years each.
The renewal fees of a trademark registration can be paid during the last 12 months of the current protection period. There is a 6 months grace period within which a late renewal application can be filed, but such a late renewal application is subject to the payment of additional fees.
• Requirements for Recordal of Change of name/address:
A Power of Attorney in the new name and/ or address Duly Notarized & Legalized up to the Consulate of Oman.
A certified (or notarized) copy of the Certificate of Change of Name and/ or address.
• Requirements for Recordal of assignment:
A Power of Attorney from the assignee Duly Notarized & Legalized up to the Consulate of Oman.
Deed of assignment executed by the parties Duly Notaized & Legalized up to the Consulate of Oman.
A certified (or notarized) copy of the Certificate of Incorporation of the assignee company or an extract of its entry in the commercial register or a good standing certificate including all relevant information. (with an Arabic translation).
• Requirements for Recordal of license:
A Power of Attorney from the licensee Duly Notarized & Legalized up to the Consulate of Oman.
A license agreement Duly Notarized & Legalized up to the Consulate of Oman.
A certified (or notarized) copy of the Certificate of Incorporation of the licensee company or an extract of its entry in the commercial register or a good standing certificate including all relevant information. (with an Arabic translation).
• Notes:
The agent for service is the only party that has the right to take actions in respect of a trademark; thus, the change of agent name and address is automatically recorded while providing a POA for the service in question.
Please note that if the applicant country is member of Apostille Convention, no need for legalization of the documents; the Apostille certification is enough.
