Filing Requirements

JORDAN

Filing Requirements:

  1. A power of attorney notarized and legalized up to the Jordanian Consulate. The power can be used for filing any number of applications on behalf of the same applicant.

  2. The name, nationality, address and occupation of the applicant.

  3. A list of the goods/services and the corresponding classes to be covered by the Application.

  4. Print of the trademark.

  5. A certified copy of the priority document must be submitted in case it is claimed.

N.B. 

It is permitted to file trademark applications and obtain official filing receipt with temporary filing number which will be final upon acceptance and fixed filing date without the legalized power of attorney which can be submitted within 3 months from filing date which also not applied strictly; however when an application is examined where the legalized power of attorney is not submitted the trademarks examiner will issue an office action requesting the legalized power of attorney and giving a one month time to submit the same which can be extended for three times.

Document 5 should be filed within 3 months from filing date.

Search results need 2-4 working days to be issued.

Official trademark office search covers word marks and Logos.

Time Frame:

The approximate time frame for completing the registration process of a trademark in Jordan is from 12-14 months.

Validity:

A trademark registration is valid for ten years from the date of filing the application.

Notes:

A separate application is to be filed for each class of goods/services.

Kindly be advised that according to the general practices of the Jordanian Trademark Office, it is possible to file a trademark application without submitting the original Power of Attorney or the priority document at the time of filing the application, since the trademark is to be filed with claiming priority.

In the light of the above, we shall be able to file your clients’ applications as soon as we receive their filing instructions. The original documents (Power of Attorney and the priority document) shall be submitted at a later stage upon the receipt of the Registrar’s notice.

Please be advised that trademark applications are examined in this jurisdiction according to the chronological order of their respective filing numbers and dates.

The Jordanian Trademark Law does not give the protection for the translation of the Trademark (word mark), apart from the well-known trademarks that the translation of the same is already protected.

Renewal Requirements:

  1. A power of attorney notarized and legalized up to the Jordanian Consulate. The power can be used for filing any number of applications on behalf of the same applicant.

  2. Copy of the final registration certificate or last renewal certificate.

Notes:

The validity of the trademark registration is ten years as from the filing date. Thereafter, a trademark registration is renewable for further consecutive periods of ten years each. 

The renewal fees of a trademark registration can be paid during the last month of the current protection period. The new trademark law provides for a one-year period for the late renewal of a trademark without payment of a surcharge. If a trademark registration is not renewed within the grace period as of the date of expiration, it will be canceled automatically.

• Requirements for Recordal of Change of name/address/legal status:

  1. A Power of Attorney in the new name and/or address Duly Notarized & Legalized upto the jordanian consulate.

  2. A certified copy of certificate of change of name Duly Notarized & Legalized upto the jordanian consulate.

• Requirements for Recordal of assignment, merger, or license:

  1. A Power of Attorney from the assignee company Duly Notarized & Legalized upto the jordanian consulate.

  2. A Deed of Assignment executed by the two parties and sealed with their official stamps Duly Notarized & Legalized upto the jordanian consulate.

• Notes:

A change of name/address may be recorded for trademark registrations only.

Trademark registrations may be assigned with or without the goodwill of the business concerned.

Recordal of assignment of a trademark registration, both parties should submit a certified copy of their Company’s Commercial Register, and the date of issuance the same should not exceed one week prior filing the recordal of assignment with the Jordanian Trademarks Office. Arabic translation of all non-Arabic documents certified by the notary public locally.
